Terms

These are our standard terms. Part one covers photography and video bookings. Part two covers websites,
SEO, analytics and automation projects. Part three applies to both. The details of any particular job, what we are doing, when, and what it costs, are set out in the booking confirmation or the services agreement we send you before we start. Last updated 21 September 2026.

Part one. Photography and video

Access and consent

You confirm you have the authority of the owner or occupier for us to attend, photograph the property and, where drone work is booked, to fly over it. If that authority is not in place, we cannot shoot.

Drone work

Drone flights are made under Civil Aviation Rules Part 101: daylight, within visual line of sight, below 120 metres, inside the boundary of the property or block, and clear of people who have not consented. If the weather, the airspace or the hazards on site make a safe flight impossible, the drone part of the booking is cancelled and not charged.

On site

Preparing and styling the property is your job. We do not move heavy furniture, artwork, valuables or appliances, and we do not clean. Anything that needs moving for a shot is moved by you or with your agreement.

Weather and postponement

Outdoor and drone work depends on the weather. Either of us may move the booking to the next suitable day at no cost. A booking cancelled with less than 24 hours notice may be charged at half the fee.

Licence to use the images

On payment in full, you may use the images and video for marketing the property, on listing portals, on your own website and in your own social media, without a time limit. The copyright stays with Purple Peaks Limited. The files are not to be resold, sublicensed to another agency or business, or supplied to a third party for its own marketing, without our written agreement.

Our own use

We may use the images in our portfolio and marketing. If you or the owner asks us in writing not to, we will not.

Delivery and reshoots

If something has gone wrong with the files, tell us within seven days of delivery and we will reshoot or re-edit that part at no charge. We keep delivered files for twelve months and no longer, so please keep your own copy.

Damage

If something is damaged while we are at the property, tell us the same day and before anything is repaired or replaced, so that we can look at it and deal with it properly. Wear, damage or defects present before we arrive are not ours.

Our liability for a shoot

Our liability for the photography service itself is limited to the fee paid for the booking, and we are not liable for loss of profit, loss of a sale, loss of a booking or any indirect or consequential loss. That limit does not apply to physical damage we cause to the property or to anything in it, or to injury, which sit outside that limit.

Part two. Websites, SEO, analytics and automation

Project work runs on a separate services agreement, signed by both of us, which sets out what we are building, what it costs and how it is accepted. The terms below are part of that agreement and are published here so you can read them before you sign anything.

What we promise

We carry out the work with reasonable care and skill. We do not warrant that any system will be uninterrupted or error free.

Changes

If you ask for something outside the agreed scope, we confirm the change and any effect on fee and timing in writing before we do it. No change to scope, fee or timing is binding unless both of us record it in writing.

Your accounts and your data

All accounts, domains, servers and subscriptions used for the work are opened in your name and remain yours. We act as administrator on them. You own your data and, where the Privacy Act 2020 applies, you hold the responsibilities of the agency collecting it. We do not hold your production data on our own systems.

Money

Nothing we build initiates, approves or moves a payment, and we do not hold your cards or access to your banking. Where we run advertising, it runs on your own account and payment method, within a budget cap agreed in writing, and the spend on it is yours.

Backups

Before any irreversible step, such as a bulk change, migration or deletion, we take a restorable copy. At handover we tell you what was copied and where it sits. If a copy cannot be taken, we say so and get your agreement before the step runs. You remain responsible for your own routine backups.

Third party services

The work is built on third party platforms chosen with you. We are not responsible for their availability, their pricing, their terms or changes they make to their own products. Subscriptions for them are taken in your name and paid by you.

Artificial intelligence

Where the work uses AI assisted tools, output is reviewed before it is relied on. You are responsible for final decisions made using it, and we tell you plainly which parts of a workflow are automated.

Content you give us

You confirm you own or are licensed to use the text, images, video, music, logos and data you supply, and that our use of them for the work will not infringe anyone's rights.

Domain names

You choose your domain names and confirm that using them does not infringe anyone's rights. We register them in your name and will raise an obvious conflict if we see one, but we do not give legal advice on availability.

What you own at the end

On payment in full, you own the deliverables made specifically for you. We keep ownership of our own tools, templates, components and know how, including anything reusable we bring to the work, and you get a perpetual licence to use those to the extent they are built into your deliverables.

After handover

Support beyond the agreed scope, including changes to third party platforms, new requirements, training and ongoing monitoring, is quoted separately. We are not on call and we do not guarantee a response time unless a support arrangement is agreed in writing.

Ending a project

Either of us may end an engagement on seven days written notice. You pay for work done up to that point. On request we hand over administrator access, credentials and documentation for anything built, and remove our own access.

Our liability for project work

Our total liability for everything arising out of an engagement is limited in aggregate to the fees you have paid us for the work the claim relates to. We are not liable for loss of profit, loss of revenue, loss of anticipated savings, loss of or corruption of data, business interruption, or any indirect or consequential loss, or for liquidated damages. That cap does not apply to death or bodily injury, or to physical damage to tangible property.

Part three. Both kinds of work

Payment

Invoices are due within 14 days unless we have agreed otherwise in writing. Any GST that applies is shown on the invoice.

Confidentiality

Each of us keeps the other's non public information confidential and uses it only for the work in hand.

Indemnities

Neither of us indemnifies the other except for claims arising from infringement of intellectual property rights, death or bodily injury, or physical damage to tangible property, and then only to the extent caused by that party.

If something goes wrong

Raise it with us in writing and we will try to sort it out in good faith within ten working days. If that does not work, the dispute goes to mediation in Canterbury before either of us starts court proceedings, unless urgent relief is needed.

Complaints about published content

If anyone tells us that content on a site we built or administer infringes their rights or is unlawful, we take it down or make it private within one working day and tell you the same day. It goes back up on your instruction once the complaint is resolved.

General

New Zealand law applies and the New Zealand courts have jurisdiction. Our work is supplied for business purposes, so the Consumer Guarantees Act 1993 does not apply. Nothing on this page limits liability that cannot be limited by law.

These terms may change. The version that applies to your job is the one published when you confirmed the booking or signed the agreement, so the date at the top matters.
